My spouses married in 2013 and had a daughter who was 20 months. In present I have permanent residence at Go Vap District, HCM City, my husband has permanent residence at Duc Hoa Rural district, Long An province.
Recently, we are raise more conflicts that cannot be reconciled. Now I would like to divorce without my husband’s signature, where can I submit the petition? Which court will settle? What are documents need to be prepared?

Answer.

Firstly, under the Civil Procedure Code (which was amended and supplemented 2011), the People’s Courts of rural districts, urban districts, provincial capitals, provincial towns (hereinafter referred collectively to as the “district-level people’s court”) where the defendants reside, work under the court’s jurisdiction will settle.
Therefore, as your husband is residing at Duc Hoa Rural district, Long An province, you need to submit the file to the People’s Court of Duc Hoa, Long An province where shall have the jurisdiction to settle your divorce request.
Secondly, you need to prepare the following documents:
– Divorce application.
– The original the marriage registration certificate.
– The identity card, passport of plaintiffs and defendants.
– The household registration book or temporary residence book of plaintiffs and defendants.
– The birth certificate of your daughter.
– The papers of property.
